Two issues are energizing prisoners. For those in WI horrific solitary conditions-it's the possibility that they might have a changing the horrific conditions.

For many others , it is what I call the "restitution scam", where the DOC is basically stealing from inmate accounts under the guise of a bill passed in the legislature which they have blatantly misinterpreted. Action and support are needed in both spheres.

note:We are trying to find penpals for strikers and people on long term solitary confinement. You can use FFUP address for your return address if you wish, Just make sure I have your real address if you want a correspondence so I can forward mail. Here is a post with some prisoners needing a friend/nurturing note who are on hunger strike and/or in long term solitary:

Here are letters from strikers so far this month( last first)
Please write a nurturing not to Daniel Dirk below.

Daniel Dirk 633088, GBCI, PO Box 19033, Green Bay, WI 54307
 born 1998, 18 years old; out date 6 2 17

On January 10th 2017, Justin Lee Douglas , an inmate in GBCI,  sent FFUP a notice about Daniel Dirk. Here are his words:” A guy by the name of Daniel Dirk, 633088 his wrist with a nail clippers! He was on a hunger strike for four meals  already and wasn’t talking to staff and CO Johnson still gave him a finger nail clippers and when she came to pick them up he refused to give them up and stated to her that he was going to use them to kill herself and she stated “no you won’t” and “I don’t care , keep them” and over an hour and a half later while rec was coming in an inmate saw inmate Dirk’s cell window covered in blood and inmate Dirk passed out in a very big puddle of blood and the sgt came to his cell and wasted 10 minutes trying to get inmate Dirk to respond before calling HSU or a supervisor up to seg and over 30 minutes for the ambulance to be called! The staff don’t do any kinds of counts during the day and then never take any inmates seriously when they proclaim that they’re Suicidal!
Justin Lee Douglas  and other inmates have gone on hunger strike- we are getting their info
The activist community is asked to mount a protest campaign and send mass mailings to all news outlets.

1)Justin Lee Douglas 322852, GBCI Po Box 19033; Green Bay, WI 54307;  bd 1982, 24y.o. out date 2022

I’ll be going to NO FOOD NOT WATER hunger strike on January 8th, 2017 until I either die or I’m transferred out of GBCI! I Plead to all of you who read this to pray for me and send any cards or letters to emotionally support me in my time of need, so that I know I’m no alone  (A.K.A.the forgotten man) my ADDRESS is PO BOX 19033, Green Bay, WI 54307. 2)Adrian Leonte White 00537065 WCI ;bd 1992;out date 10 21 17

My name is Adrian Leonte White and this is my first time writing you and won’t be my last!  I’m writing you in regards to ”hunger strikers” and the “cruel and unusual punishment “ that goes on around her that never gets heard because people either are “too insane to understand” because of Medical abuse by psychiatrist or people being put on AC till they go literally insane. I ‘m going to start with me and my situations. I’m on hunger strike, it’s been almost one week. I’ve only been pulled out one time by Amy Gunderson, she do not work over in WCI full time no more. I’m on my strike because of the AC people and how they sexually abuse us and the list goes on. But I really need you to pass my name on to people who reach  out for the hunger strikers and all the newsletters Because the AC and other crap needs to stop.
I’m a 23 year old Black man, for the first time in my life, I’ve never seen no shit like this in my life of living! These COs are really in Waupun raping, lying to other inmates about what another inmate said about their crew just to get a fight started, stealing medications and taking them home. Putting their fingers in people’s assholes, not one time but 5 other times since I been here at WCI- letting the homosexuals have  sex with Cos and inmates.  The staff are now going around asking all the inmates if they are gay or bisexual. And now the business office is taking 50 % of people’s money. So now if you had a court order that 50% be taking away for you, now 50% more is taken away and that’s 100%. Its crazy because some inmates are going to court because some of us are court ordered only 25% under Act 355 I think. We have not been noted by authentic people, only Department of Corrections! Other Cos are going around saying:”We are going to break you mother fuckers down.”Waupun is a mess and the lady C0 who got stabbed was calling the inmate “fag “and other unprofessional things. I am a short timer, I go home in 10 months and I’m going to fight with you and other people to stop this insanity! I’m thinking about starting a TV and other property program because people can’t afford anything and the CO take action against that. They don’t want us to have shit! They Say we are “pigs and pigs get shit and eat it.”They make over 100 thousand dollars of food and feed us small amount. All of our food goes in the trash!
At end, asks to be connected to advocacy groups and lists of resources for free clothing etc

 3) Latest Letter From Cesar DeLeon:
Lucas Alan Dietsche , EXPO
Lucas,Revolutionary Greetings,
…Well as you can see I’m still alive and fighting.  I want to thank you for having my back during these revolutionary times.  I feel bless having all of your solidarity behind me.   Somehow my body is adopting to withstand the blow and water boarding-like torture techniques that the DOC is resorting to in order to silence and try to get me off my hunger strike.
On Dec. 20, 2016 I had court-hearing to discuss the unethical torture techniques that the DOC re using against me... The prison doctor Dr. Jeffry Manslove, testified that the reason that I’m near death (near death comes every 2 to 4 days for me because my hunger strike includes fluids as well), was because “they were trying to get me eat.” Meaning that he is using the authority given to him by the court-order to feed and hydrate, “as a method of coercion” to try to end my will, rather than for its intended purpose of providing medical treatment to prevent injury and death from dehydration and starvation.
Because I don’t know the law the DDOC and Judge took advantage of me and the Judge sided with the DOC and he, Judge Steven G. Bauer, told me that “if they kill me my only consultation would be that my family had grounds for civil claim gains the DOC.”
This is a summary of what took place but to see the full version, you can see the court transcripts on line (?).  The case is WIS DOC vs Cesar DeLeon #322800;  Dodge County Case No. 16VC301

And so now because the Judge gave the prison doctor the greenlight to conduct water boarding-like torture techniques against me, the DOC is now also using the same techniques on all Wis. Prisoners who are on Hunger strike…

My brother Lucas, we have to get the ACLU involved in overturning this decision or else the DOC is going to break everyone who is on hunger strike.  I’m staying strong because I’m well focused on my objective, but others may lack the commitment necessary to withstand the torture and harassment techniques…Besides the water boarding-like torture techniques the person officials have been performing other stress-assessment techniques.  Every time they extract me from my cell to do the daily evaluations (to determine whether I’m near death or not, to see if I”qualifty” for rehydration) the guards take this opportunity to use excessive force, and to ram-sack my cell.  They look for anything that would give me them an excuse to take my paper and clothes (right now I’m on a 10 day clothes restriction as we speak)
This same tactic of rehydrating prisoners’ only when they’re near death, was also used the prisoners at Guantanamo Bay.  A lot of them, as a result of being subjected through that technique developed a serious medical condition known as Rehydrating Syndrome.  Maybe if you have the time or can find someone who has the time, you can do a little research on that and find the case that heard in court’s well as the motion filed to stop the government from torturing the prisoners.  This just in case the ACLU don’t want to get involved than I can use these motions to file them in court myself and try my luck.
What I would really, really, love it would be if we can open up a “Fund Me Page” for anything related to this hunger strike.  Because unfortunately no attorney wants to do anything for free and without an attorney our struggle faces unnecessary difficulties that dissuade a lot of the prisoners form striking or getting involved.  Do you think you can discuss that with other comrades?

Lucas I can’t leave this struggle half-way down the path.  In time like this you really get to know your strengths and what you are made of.  And I know I can handle this I’m strong and even stronger now thanks to all of you.  So let’s keep the fight against long term solitary confinement which is the DOC’s min source of power and control against prisoners.  If we can win this fight we are shifting the balance of power that influences the elemental environment forces of prison life.  Yes, this fight for the balance of power.
You don’t have to come to Milwaukee to visit.  You can come to Waupun. Infact, if you cane to Waupun the visit would be longer (up to 2 hours).  At Milwaukee the visits are 20 minutes. My family does worry but spoke with them and we came to an agreement.  I will use my one phone call per week on them and they’ll make room for you and others to visit.  So we can take of business.
What became of the extra project you were working on with the Communist Creative Writing Correspondence Curse?  Are you still working on that?  Educating the prisoners is the first step in getting them involved. It helps develop a sense of responsibility and idealism.  But like I said, it has to be real basic.  The majority of state prisoners are ignorant about these things.   They lack some basic education.
So what were the end result and/or FBI’s report on the Lincoln Hills investigation?  The FBI should have had finished their John Doe investigation by now, right?  I don’t have my TV and radio the guards took them because I have refusing to come out of my cell for the forced feeding evaluations. So I’m cut off from the news.
Well comrade I hope to hear from you soon in the meantime Ill carving the path for others to follow…
In struggle,Cesar

4)Late 2016 call for support from WCI
 https://ffupstuff.files.wordpress.com/2017/01/tommie-carter-hunger-strike-news-12-22-16.pdf

Ms Swan, On December 1, 2016, the Department of Corrections was granted a one year order for involuntary evaluation, feeding and hydration of me. I have continuously refused to voluntarily consume any nutrition or hydration in protest of the constitutional violations here at Waupun
I      In addition to being deprived of minimal civilized measure of life’s necessities as described in “the nature of the hunger strike” that I submitted incase no 16-cv-572 as we are experiencing unrelenting and crushing mental anguish, pain and suffering as a result of the inadequate mental health treatment and many years that we have spent without normal human interaction, in stark and restrictive conditions, without any hope of release from this living nightmare that does not end and will not end.
Ms Swan, the devastating psychological and physical effects of prolonged solitary confinement here at Waupun is well documented to cause mentally ill inmates significant mental harm and places them at grave risk of even more devastating future psychological harm.
As evident of this, me and Mr Cesar DeLeon endure beatings every single day. Because we will not allow WCI officials to weaken and undermine us or break us , as they have claimed, we are causing problems by brainwashing other inmates to go on hunger strikes in support of the protest. Additionally, we were told, that if we continue ti not come out our cells to be forcibly feed or hydrated by WCI nursing staff we would be beaten, So we are beaten, tased or sprayed with substances that are capable of causing death, These agents affects your ability to breathe or see for long periods of time. Dr Salam U Syed recently testified that my health is still deteriorating and that my urine specific gravity show very large amounts of ketones and that my blood work for electrolytes are not normal which could cause metabolic acidosis, electrolyte imbalance, cardiac complications, coma and death.
I believe these are scare tactics because if my gluconeogenesis(?)were in full effects by producing energy from non-conventional sources in my body, I would have been hospitalized already(if it were not in full effect?)

These are the following prisoners at WCI who are on an active hunger strike:

Tommy Carter,Cesar DeLeon,Jose Soto ,Brion Nash, Walker, Redmond,Davis

I am also placing you on notice that these people are fabricating these meal monitor logs claiming that we are eating in an attempt to get us off our strikes. It’s just another tactic they use. Please call up here to WCO and inquire about us see what they tell you. I believe another round of protest outside WCI should be done ASAP but this time turn the heat up

5)update on strike from Jose Soto
From letter BY Jose Soto 307830 WCI:The strikers.. I cannot truly give names and be accurate as I am on c- lower range with Cesar De Leon (I’ve known him since he was a kid) and there aren’t any other strikers on our range. I was force fed for a while, but came off die to famly issues , BUT I am assisting DeLeon on filing complaints to exhaust and sue. They do NOT monitor meals properly- they come @ lunch and mark down % ate at breakfast! Those on court order- the petition for some seems to be carbon copy, rubber stamping.WCI says NO negotiations for strikers-eat or not we don’t care- they are ONLY feeding us when our urine has ketones –or –we are nto well on assessment, so NO daily feeding. They say short nurses and too much work. Essentially we’re fed-lest roq- three days until ketones show up and fed again. I got DeLeon a court hearing and the judge told him the DOC is not violating law or his constitutional rights.
6)The One bright Spot, three letters from LaRon McKinley, doing well, will soon be in general population in another state after 27 plus years in Solitary!!
LaRon is sill going forward with his lawsuit demanding and end to long term solitary. Here are his demands for us to carry forward:

Neo SLAVERY? -prisoners and their families hit hard by new DOC policies

UPDATE Below is from a  post first published in November on our "prisoner reach out" blog- it is still relevant and action is need now.:.

Click  to download  letter requesting a John Doe Investigation.
Click to view request for John Doe Investigation on blogspot..
This letter was written by the prisoner litigator Nathaniel Lindell. We are circulating it widely and ask all those concerned who have a loved one who is effected by this, to download this letter and fill in the blanks to add your own story. For those who are not effected we ask that you write a letter expressing your concern . All this will go to the court, legislature and media. We must stop this scam. The DOC believes it is invincible and can bulldoze through any law and rules.

Any problems downloading or questions about what we are dong, contact pgswan3@aol.com

Late November post: Introducing the issue:
“NEO SLAVERY” encroaches on WI DOC?

TWO DISTURBING SYSTEM WIDE CHANGES

"NEO SLAVERY"  and "NEW Slavery" are terms I am beginning to read more and more in WI prisoner letters. Very important and disturbing stuff.  I will link this to some of the essays and here summarize.

1) The legislature enacted Act 355 last April , which directed the WI DOC to take 50% of incoming funds from prisoners jobs for “restitution”, the amount the court ordered the prisoner to pay to victims at their sentencing. Previously to this, 25% was taken.

The DOC however, is taking 50 % from all funds coming in including moneys from families and they are doing it retroactively- taking for years served before the Act was passed.

This has a big impact on families and prisoners. They are already reeling under the weight of many fees and the wages made by the few who do work within the system are incredibly low  . Here is a chart from one of the writers of the articles below, Reo Covington:
After all deductions, this prisoner gets 6.45 for 80 hours work. Where's the rehabilitation? He asks.

As you can see the 50% is added to a myriad of fees already charged to inmates.

The two articles below do a good job of explaining the whole debacle.

Below Reo Covington talks about the total lack of interest in rehabilitation that is displayed- what is the incentive for the prisoner to do good work and take a job when after 80 hours of work he makes $6 .45
2)The second new policy is hard to understand except cynically.  Here is where the term “Neo Slavery” is most apt.

Here is one report form SCI= am gathering the others recieved and will add them
Sharks in a fishbowl? https://ffupstuff.files.wordpress.com/2016/11/r-mallory-money-stolen-by-doc.pdf
Summary:

FFUP has received many letters (and a few calls from families)that the prison is now taking ALL incoming funds for many prisoners’ accounts. They have come up in many cases with bills (restitution, legal loans etc)they say prisoners have not paid but that prisoners attest they have. Many of these “bills” are 20 plus years old and the prisoner, of course, has no receipt.  And when Families do come up with legal proof of payment, the DOC refuses to restore the funds to the Prisoners account.  One prisoner a 76 year old very ill man, is refusing to pay his 7.50 copay for health care in protest and has been refused treatment (although some advocacy seems to be working in changing that). He attests the bill was paid by his girlfriend long ago.  This man is indigent- has zero funds but occasionally will get a money order from friends. He has asked all not to send anything as the prison will take 100 percent.
What kind of money grubbing is this? The food rations have been cut , few prisons give the free stamps out to indigent prisoners anymore and there is virtually no programming or treatment for the majority of prisoners.

One theory I have read from inmates is that all this is preparation for privatization, something Governor Walker has long wanted. This writer has attempted advocacy within the Michigan system where many prisons are privatized. There is no access and any changes are impossible. No matter how draconian our system gets, I strongly state, privatization is not the answer.

And January 16th additions to essays: typed versions are coming

Request for John Doe Investigation , letter to court and intro to you

Your help needed : a call for a John Doe Investigation

Prisoners and their families and concerned citizens are outraged at a new DOC policy that in one inmates words turns the WI prisons “into both a debtors’ prison and a collection agency. Debtors' prisons are unlawful in this country and being a modern-day collection agency is not part of the DOC’s initial charter or part of and rehabilitation mission.”

At issue is blatant misinterpretation of a bill passed in the legislature last June, “Act 355, Wis Stat 301.32 which authorizes the DOC to take 50 % of money from funds sent to prisoner, but only for “surcharges” from criminal cases, and money from Wages paid to prisoners for “other obligations” if a prisoner has “acknowledged..them in writing” or they court ordered. DOC has been rampantly taking sometimes100 percent of everything coming in from vulnerable non litigating prisoners and from everyone, taking funds retroactively and are coming up with bills that have already been paid or were made before restitution existed.

Nate Lindell, fine litigator, has written a letter that asks the court for a John Doe Investigation of this important matter. This is a template letter, and families can put their own name and info where asked or use this as a model to write their own request. Those who have a story of this abuse should make sure they get their information into the letter for the examples here are from a few prisoners in WSPF only and we know this policy has caused widespread suffering. As of this writing , four activist organizations (EXPO, IWOC,WISDOM, FFUP)are coming together to push for this John Doe Investigation. We will gather all letters and submit them at the same time in a way that makes the most impact.

For now, until the final submission committee is formed, send your completed letters to FFUP c/o 29631 Wild Rose Drive, Blue River, WI 53518.For questions, call 608-536-3993 or email pgswan3@aol.com. Also, if you would like this in a word document so it can be changed on your computer as you need, email us.

We are also sending a letter that has more space provided for handwriting to some prisoners in hopes they can spread the word. They can send to family members to send to the court or to FFUP, (same address as above)

We thank you for any help you can give in this important matter

                                                   Circuit Court

State of Wisconsin                      branch____________    Dane County

(print name )__________________________________________     Case No. 16-JD-

Petitioner,

Vs

John Schwochert, Cathy Jess etc

Proposed Defendants

Petition for John Doe Proceeding, Pursuant to Wis Stats 968.26

To: Clerk, Dane County Circuit Court

215 S Hamilton St, Suite 1000

Madison, WI 53703

The above named petitioner , (print last name)____________________________________________

proceeding pro se[If you have an attorney, delete pro se and put “represented by”], moves the court under 968.26, stats., to refer this matter to the District Attorney (D.A) with directions that the D.A. investigate the matter described herein and prosecute the crimes the DA discovers; and if the DA declines to reasonably investigate the matters or declines to prosecute crimes discovered/revealed, petitioner asks this court to conduct an evidentiary hearing where it considers the appropriate evidence and then directs appropriate prosecutions.

In support of the petition, the petitioner represents as follows:

1.Jim Schwochert (“Jim”) is and, at all relevant times, was the administrator for the department of adult institutions( D.A.I.). Jim signed an October 3rd 2016 memo addressed to all adult prisoners, Corrections Complaint Examiners, Cathy Jess and DOC Legal Counsel. In said memo Jim stated that money would be taken from prisoners account for “fines, court costs, and attorney fees” which would include “but not[be]limited to loans, filing fees, VWS, DNA surcharge, (sic)…child support, disbursements, transportation, room, medical copay, institutional restitution.”

       2. As noted in State ex rel. Harris V Larson, 64 wis.2d 521,527(1974),

“if the legislature did not specifically confer a power, it is evidence of  legislative intent not to   permit the exercise of the power”

       3. Stat.301.32 (1), recently amended by ACT 355, only authorizes the WDOC to take money from funds sent to prisoner by their loved ones for various “surcharges” or “restitution”. Wardens do have the discretion to approve or disapprove prisoners’ requests for how prisoners spend this money, but 301.32(1) does not authorize wardens or WDOC officials to force a prisoner to spend the money in any particular way other than surcharges or restitution.

       4. Stat 301.31 authorizes the WDOC to take money from wages paid to prisoners for “other obligations” if a prisoner has “acknowledged.. them in writing” or they “have been reduced to judgment.”

         5. Apparently construing the forenoted statutes in conjunction with 973.08(1), Stat (says that judgments of convictions (J.O.C.) must be delivered to the prison by the executing officer, the deputy who brings a conviction to prison), as must be done- see WI Bankers Asso.V Mutual Sav. & loan Asso. 96 Wis.2d, 438, 454(980) (related statutes must be construed together to determine how they’re to be enforced)-given that the first two statutes concern debts decreed in JOCs…for over 20 years the WDOC has only enforced/imposed financial obligations identified in prisoners’ J.O.C.s, which have been delivered to prisons.. See Butzlaff V WI Paersonnel Com. 166 wis 2d 1028, 1031-32(ct App 1992) ( Courts defer to “regular and repeated interpretation of [a] statute..over a period of time by the agency charged with the duty of administering [it]” ( cites omitted)

          6. Act 355, recently passed, amended 301.32(1)so that money may now be taken form funds sent to prisoners for restitution. But no other changes were made to 301.31, 302.32(2) or 973.08(1). Thus there was/is no grounds for Jim or WDOC to reconstue these statutes to mean they may:

a) use a vendor ( i.e. Marquis Corp.) as noted in Exhibit 1, to search for debts prisoners may owe and take prisoners funds to pay those debts prisoners may owe and take prisoners’ funds to pay those debts rather than passively process J.O.C.s delivered to prisons by court officers executing the judgments or acting on judgments issued against a prisoner in civil litigation.

 b) take money from prisoners for supervision fees, attorney fees or other supposed debts not reduced to judgment or acknowledged by prisoners, from either prison wages and/or gift funds sent to prisoners.

c) take money from prisoners for fees, costs, restitution, and /or other supposed debts that prisoners already paid long ago;

d)rely on CCCAP and /or Marquis Corp. to determine what debts a prisoners has, with no J.O.C. supporting the determination;

e)through DAI policy + Procedure 309.45.02 signed into force by Jim and other WDOC officials, take funds from gift money sent to prisoners to pay more supposed debts that just surcharges and restitution.

f)per DAI policy + Procedure 309.45.02 III.C., refuse to refund improperly deducted funds, thus revealing that they expected funds would be improperly-i.e.-illegally- taken from prisoners.

7.Some specific examples of the illegal activity noted in #6 above are listed below(7) and include but are surely not limited to these situations experienced by prisoners on ONE unit at the Wisconsin Secure Program Facility (WSPF). Petitioner believes there are thousands of other prisoners who’ve also the experienced these illegal actions. They include:

a) Mustafa-El K.A. Ajala, W.D.O.C.(223971) being obligated to pay 70 $ in court costs for case no 93-CF-878, which Mr Ajala believes he paid over a decade ago.

b) Dwayne Cox. W.D.O.C. #843241 being obligated to pay 100$ for a victim witness surcharge (VWS) for case No92-CF-1662, which Mr Cox knows he paid over 20 years ago-five dollars was taken (by Ms. Sutton ,at W.S.P.F) out of a 10$ money order Mr Cox received on 9 Nov, 2016, for the bogus 100$ recharge.

c) Dion Matthews, WDOC #254399 being obligated to pay thousands of dollars for restitution, surcharges and fees for various criminal cases from the 1990s, some of which he has long since paid, others of which are not based on JOCs delivered to prison.

d)Nate A. Lindell, WDOC #303724 being obligated to pay: three separate amounts of restitution (i.e.1.40$, $0.47and 26.35$) for case No. 97-CF-140,even though the JOC for the case doesn’t list any restitution being owed and the sentencing judge specifically refused to order restitution; two separate amount of restitution(i.e.11.81$ and 46.39$)for case No.94-CF-566, even though no judgment stating these obligations was served on a prison and Lindell paid all restitution for the case over 20 years ago; restitution in the amount of 33.45$ for case no 95-DF-1173, even though Lindell paid that over 20 years ago and no JOC stating that obligation was served on a prison, 260$ for a 1995 “Supervision fee”, that the WDOC has no authority to collect and Lindell believes he doesn’t owe; 24$ in court costs for case no. 97-CF-1173, which the WDOC has no authority to collect and Lindell believes he doesn’t owe; 24$ in court costs for case NO.97-CF-140, which Lindell paid over a decade ago and 20$ each in court costs for cases Nos. 94-CF-556 and 95-CF-1173 which Lindell paid off and no J.O.C.s listing those obligations was served on a prison, multiple “non- restitution surcharges” that Lindell either paid or no JOCs concerning them were served on a prison.

All of the forenoted prisoners filed a group complaint (i.e. # WSPF-2016-22206), explaining, as noted above that the WDOC didn’t have authority to impose the forenoted obligations on their accounts. But the complaint was dismissed.

         8) Due to Jim’s forenoted new practice and policy, the petitioner had these new financial obligations imposed on him: (write you’re your experience)

______________________________________________________________________________

______________________________________________________________________________

______________________________________________________________________________

(Continue on end or another page)

     9) the prisoners notes in #7 above, are all in WSPF, the petitioner believes that many prisoner in every other prison are experiencing the same illegal treatment.

     10) It may be that prisoners are being made to pay court-ordered debts that were already paid because WDOC staff stole the money rather than delivering it to the courts or appropriate parties; Or that Marquis gets paid more the more they make us pay. DOC’s cashier unit gets 59% of everything they collect, so that’s more motive to collect more. Or it may be that WDOC staff are basing their assessment on what debts are owed on an impermissible, non-credible source, other than JOC served on prisons. The first scenario would violate 943.20 Theft ,sub.(b); while the second scenario would violate  946.12  Misconduct in public office, Sub (2).

        11) Despite Mr Lindell, noted above, mailing DAI Director Jim Shwochert a memo, on 16 Nov 2016, explaining how his new policy and the practices it caused are illegal, as explained above, Jim has not put an end to said practices, it’s likely that hundreds of other prisoners also wrote Jim and/or other WDOC staff objecting to the illegal practice of taking prisoners’ money for debts already paid or not enforceable by the WDOC.

          12) In conclusion, all of the DAI /WDOC officials note herein and the “vendor,” noted in 6a above, along with, no doubt, other state and private persons, are in collusion to illegally take prisoners’ money.

Crimes Believed to Have Been Committed

Solely based on the presently known facts-the DA will uncover more during his investigation-the petitioner believes that the state officials and private persons noted herein are guilty of being party to the crimes (939.05(2)) of:

       (a) 943.20 theft, (b);

( b) 946.12 Misconduct in public office, sub (2);

(c)946.68 simulating legal process, sub (1r)(i.e. Jim sent a memo, which purported to be authorized by law, when it wasn’t , in the name of the Department of Adult Institutions and,

 (d) 946.80, Wisconsin Organized Crime Control Act (WOCCA) because:1) the precursor crime of 946.12 has been committed 2) more than three times by (3) on “enterprise” of government employees spread across the entire state.

Conclusion

As the presently known facts support the petitioners belief that the fore noted crimes have been committed, 968.26(2)(am) requires that the matter be referred to the DA by this court, with directions that the DA comply with sub(2)(b). The petitioner urges the DA to obtain and review complaints filed by the prisoners concerning these matters (Mr Lindell and other prisoners note on all complaints that they waive confidentiality) and correspondence to WDOC and DAI officials on these matters, as well as any contract or agreement with the “vendor” Jim referred   to, WDOC and DAI staffs’ emails on the issue, other correspondences and request the basis for the new obligations imposed on prisoners noted herein and discovered by the DA.

Respectfully submitted,

COLORADO Does it right

Here is a template for us- brought to us by our own former DOC Secretary Rick Raemisch-he left WI DOC to help make a humane and effective system in Colorado and now is trying to spread the word.

Dee Hall of the Wisconsinwatch article says it best:
             their website:http://wisconsinwatch.org/2016/06/colorado-prisons-slash-use-of-solitary-will-wisconsin-follow/

Here is the article on downloadable pdf:
A good picture of what is happening in Colorado is this chart showing drop in use of Solitary confinement:

Also they have a very transparent website with all the rules followed. Here are a few we should use as models:
\CO rules to study for what we can use:

1https://ffupstuff.files.wordpress.com/2016/12/co-close-custody-rules.pdf

this is what they have for really dangerous prisoners

2)scope of mental health services:

https://ffupstuff.files.wordpress.com/2016/12/co-scope-of-mental-health-services.pdf

3)scope of health services:

https://ffupstuff.files.wordpress.com/2016/12/health-scope-of-service.pdf

4)
Prison Rape Elimination Act (Prea): https://ffupstuff.files.wordpress.com/2016/12/prison-rape-elimination-act-co.pdf. in Wisconsin prisoners say PREA is a joke. In CO it works.

5)https://ffupstuff.files.wordpress.com/2016/12/co-grievance-procedure.pdf_ this is complex- one WI prisoner suggested we bring back the federal ombudsman program. Good idea.

And here is the second arm of our solutions proposal: A mental health treatment center as was mandated in Flynn V Doyle lawsuit and which brought the TCI prison( women's) a mental health center. Here is what it looks like:

Write a prisoner

Below are prisoners now on long term solitary confinement, many on hunger strike, and many mentally ill in no way able to cope with the conditions- your encouragement can mean the difference between life and death and also can be the light in their life that shows them how to survive this ordeal with psyche intact.

We are always available for questions or complaints if you do decide to write an inmate and we also offer forwarding mail service if you do not want to give the prisoner you address. email pgswan3@aol.com for more information.

Except for the first two prisoners listed here, prisoners below were part of lists sent by other inmates and we have written some and want to write more to get their stories and offer encouragement. GO to Stranded friends for stories of more prisoners who need better contact with the outside world .All could use your encouragement . Some of the data on the inmates listed on AC at bottom of this post is  disturbing- so young, mentally ill , getting no treatment and instead they get indefinite solitary confinement. For some, it looks like they will be released this year- untreated, with no programming.

We need help reaching out to many of these inmate and if you do decide to help , feel free to use our return address and let us know your real address. Ask for their story and you can tell them that we will spread the word about their predicament and will write back . If you want to be part of this, email pgswan3 @aol.com to get started.
Go to Stranded friends for more prisoners who have given us their stories and email us if you choose to write inmates at end of list who are on AC and we have no contacted yet.

My name is Justin Lee Douglas #322852 and I’m a 34 year old white male who is in prison in Green Bay Correctional Institution (GBCI).I’ve have a hernia for over 18 months and have been steadily denied adequate main medications! I’ve also been taken off all my anxiety medications and have been in segregation for 16 months and I’ already a mentally ill inmate (MH2B) and being in segregation is only making me worse! Thank you very much for your support.

Please write a nurturing note to Daniel Dirk below.
Daniel Dirk 633088, GBCI, PO Box 19033, Green Bay, WI 54307
 born 1998, 19 years old; out date 6 2 17

On January 10th 2017, Justin Lee Douglas , an inmate in GBCI,  sent FFUP a notice about Daniel Dirk. Here are his words:” A guy by the name of Daniel Dirk, 633088 his wrist with a nail clippers! He was on a hunger strike for four meals  already and wasn’t talking to staff and CO Johnson still gave him a finger nail clippers and when she came to pick them up he refused to give them up and stated to her that he was going to use them to kill herself and she stated “no you won’t” and “I don’t care , keep them” and pver an hour and a half later while rec was coming in an inmate saw inmate Dirk’s cell window covered in blood and inmate Dirk passed out in a very big puddle of blood and the sgt came to his cell and wasted 10 minutes trying to get inmate Dirk to respond before calling HSU or a supervisor up to seg and over 30 minutes for the ambulance to be called!

Write A Prisoner! with either a friendly card or longer term penpal relationship- this is one of the  most rewarding ways to get involved.

Adrian Leonte White 00537065 WCI ;bd 1992; 24y.o.;out date 10 21 17

 His friends call him "Uhuru".

This man has been a mentor to me, along with a few others in there, for the 16 plus years I have worked with inmates and their families. I consider him a visionary and political prisoner, Shortly before the hunger strike started, he was transferred to Columbia  Correctional and has been completely isolated from the rest of the movement. He needs encouragement and would love to write to someone who is serious about justice. He continues to do nonstop legal work and has many essays -you can see his writing, legal work and petition to DA in Washington here.

Here are some prisoners under 30 who are on administrative confinement(AC)- long term solitary with no definite ending and no definite reason. After being told that 15 new people were just put on AC at WSPF, FFUP did an open records request asking for all names and numbers of AC prisoners> The list has 77 names. Here are a few of the younger ones.

Even a nurturing card would help these guys feel less alone. And, if you feel like writing a personal letter to prisoner or a nurturing note, you can use FFUP’s return address. Just make sure I get the real address of you want the prisoner’s  response. Here is the return address( if you do not want the prisoner to have your real address): Your name c/o FFUP 29631 Wild Rose Drive, Blue River, WI 53518.

If you don’t want to write a personal letter: you can send this template letter>
